In the event of conflict between these Terms and the EULA regarding software use, the EULA shall prevail.

You must not use such marks without the prior written permission of TruOptim.
**3.3 Third-Party Marks.** All other names, logos, product and service names, designs, and slogans on this Website (including but not limited to "Claude," "Microsoft Copilot," "ChatGPT," "Azure," "OPC UA") are the trademarks of their respective owners. TruOptim is not affiliated with, endorsed by, or sponsored by these third parties unless expressly stated.
**3.4 Limited License.** Subject to these Terms, TruOptim grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial informational purposes. This license does not include:

(b) Any collection and use of any product listings, descriptions, or prices;
(c) Any derivative use of the Website or its contents;

(c) Contractual commitments of any kind;
(d) Professional financial or investment advice; or
(e) Representations of results you will achieve.
**5.1.3 Methodology.** Calculator estimates are based on:
(a) Industry benchmarks and averages that may not apply to your specific situation;
(b) Assumptions about implementation, usage patterns, and operational improvements;
(c) The accuracy and completeness of information you provide; and
(d) Generalised models that cannot account for all variables affecting your operations.

**5.2.1 Purpose.** The Industrial AI Readiness Assessment ("**Assessment**") is a self-evaluation tool designed to help organisations understand their preparedness for AI adoption in industrial settings.
**5.2.2 Self-Assessment Only.** The Assessment:
(a) Is based on your self-reported answers and perceptions;
(b) Provides generalised guidance based on common industry patterns;
(c) Does NOT constitute a professional audit, consultation, or certification;
(d) Cannot account for all factors relevant to your specific organisation; and
(e) Should be supplemented with professional advice before making significant decisions.
**5.2.3 Results Disclaimer.** Assessment results and recommendations:
(a) Are automatically generated based on generalised models;
(b) May not accurately reflect your organisation's true readiness;
(c) Are provided for informational and discussion purposes only; and
(d) Do not guarantee success with AI implementation.
### 5.3 Data Collection for Interactive Tools

**6.2 Simulated Data.** You acknowledge that:
(a) All data in the Sandbox is synthetic and simulated;
(b) Sandbox simulations do NOT represent any real-world facility, process, or equipment;
(c) Performance observed in the Sandbox may not reflect actual production performance;
(d) The Sandbox is provided for evaluation purposes only and should not be used for operational decisions.
**6.3 Trial Terms.** If you proceed from the Sandbox to a free trial of the TruOptim Industrial AI Gateway software:
(a) Your use of the software trial is governed by the EULA, not these Website Terms;
(b) Trial terms, including duration and automatic conversion to paid subscription, are set forth in the EULA;
(c) You should review the EULA carefully before starting a trial.

## 7. ANNUAL IMPROVE COMPETITION
**7.1 Separate Terms.** Participation in the TruOptim Annual Improve Competition ("**Competition**") is subject to separate Official Competition Rules that will be published when the Competition opens.
**7.2 No Obligation.** References to the Competition on the Website are for informational purposes only and do not obligate TruOptim to run the Competition or offer any specific prizes.
**7.3 Eligibility.** Competition eligibility, rules, prizes, and judging criteria will be specified in the Official Competition Rules. TruOptim reserves the right to modify, suspend, or cancel the Competition at any time.

(i) Attack the Website via a denial-of-service attack or distributed denial-of-service attack;
